Affiliate Terms & Conditions

Thank you for your interest in becoming an affiliate of Hawkeye Dynamics Ltd. Our affiliate program is designed to reward individuals and organisations who help promote and sell our training solutions — including online courses and in-person programs — to clients who operate in high-risk or complex environments.

These Affiliate Terms & Conditions (“Agreement”) outline the rules, responsibilities, and legal obligations that govern your participation in the Hawkeye Dynamics Affiliate Program. By enrolling in the program, you (“Affiliate”, “you”, or “your”) agree to abide by this Agreement and any updates we may implement from time to time.

Please read the following terms carefully before participating in the program. If you do not agree with any of the terms outlined, you should not register or continue as an affiliate.

1. Eligibility & Acceptance

To join the Hawkeye Dynamics Affiliate Program, you must:

  • Be at least 18 years of age
  • Have a valid email address and active payment method
  • Own or manage a platform suitable for promotional use (e.g. website, social media account, newsletter, podcast, professional network)
  • Not promote content that is unlawful, offensive, or contrary to the values of Hawkeye Dynamics

Upon submitting your application, we will review your request and notify you of your acceptance. We reserve the right to approve or decline any application at our sole discretion, with or without reason.

By being accepted into the program, you agree that:

  • You are bound by these terms and any subsequent updates
  • You will act in good faith and with professional integrity when promoting our offerings
  • You will represent our brand accurately and refrain from making false or misleading claims

2. Program Scope

As a registered affiliate, you are authorised to promote a select range of Hawkeye Dynamics training programs and digital learning products using a unique tracking link provided to you through our affiliate system.

You will earn a commission for each qualifying sale that results from your referral. Commissions are paid based on product type and subject to the terms outlined in this agreement.

Scope of the program includes:

  • Online self-paced courses (digital products)
  • In-person hostile environment training courses
    • In-person referrals are tracked manually through direct identification or verified forms, not via the affiliate dashboard.
  • Supporting marketing content provided by Hawkeye Dynamics
  • Commission tracking and reporting via our affiliate dashboard

Excluded from the program:

  • Third-party services or partner offerings advertised on our website but delivered by external providers
  • Products not explicitly listed as commissionable in the affiliate dashboard

You are not authorised to:

  • Represent yourself as a member, employee, or agent of Hawkeye Dynamics
  • Enter into agreements or make representations on behalf of Hawkeye Dynamics
  • Promote or sell services outside the scope of this program

3. Commission Structure

As a Hawkeye Dynamics affiliate, you are eligible to earn commission for promoting and referring sales of our training products and services. Our commission structure is based on the type of product purchased and is outlined as follows:

a) Digital Products (Online Courses)

Affiliates will earn up to 30% commission on each qualifying sale of an eligible online course purchased via their unique referral link.

  • These are self-paced, digital training courses accessible through our website.
  • The standard commission rate is 30%, but may vary depending on promotional pricing or special campaigns.
  • You will receive credit for the sale if the customer clicks your referral link and completes the purchase within the referral window (typically 30 days).

b) In-Person Training Courses

Affiliates will earn 10% commission on qualifying referrals for our in-person training programs, including:

  • Hostile Environment Awareness Training (HEAT)
  • Hostile Environment Integrated Security Training (HEIST)

These are high-value, instructor-led programs with limited seats (maximum of 12 participants per course). Due to the operational costs of running these in-person events, the commission rate is fixed at 10%.

To receive credit for an in-person training referral, one of the following conditions must be met:

  • The client selects the affiliate’s name in the “How did you find out about us?” field on the official Expression of Interest form (via our website); or
  • The client emails [email protected] before enrolling, clearly stating who referred them.

Important: Because in-person courses are not purchased through our website, affiliate dashboard tracking does not apply. Commission is only paid when the referral can be verified through these manual methods.

Commission is calculated on the training fee only, and does not include any other associated costs, such as travel, accommodation, food, or third-party expenses.

Commission for bespoke or custom in-person training courses (outside of standard HEAT/HEIST offerings) will be assessed on a case-by-case basis. Please contact us in advance if referring clients to tailored training.

Commission is only paid if we can clearly confirm who referred the client prior to payment or enrolment.

c) Third-Party Services

Some services promoted on our website are delivered by external partners under separate agreements. These services do not qualify for affiliate commissions and include (but are not limited to) insurance services, background checks, or partner-led training offers.

If you’re unsure whether a service qualifies for commission, please contact us before promoting it.

d) Commission Basis

All commissions are calculated on the net sale price, which means:

  • Price paid by the customer minus any applicable discounts, taxes, refunds, payment processing fees, or transaction charges.

Commission is only earned on successfully completed transactions that are not refunded or cancelled.

4. Payout Terms

We process affiliate commission payments on a monthly basis with the following terms:

Payout Schedule:

Commissions are paid out monthly, typically within the first 10 business days of the following month.

Minimum Payout Threshold:

You must reach a minimum of $50 USD (or equivalent) before a payout is issued. If this threshold is not met, earnings will roll over to the next payout cycle.

Payment Methods:

Payouts are made via PayPal or bank transfer. You must provide accurate payment details within your affiliate dashboard to receive payments.

Refund Policy Window:

Online course purchases are non-refundable. All sales of digital products are final, and no refunds will be issued once a transaction is completed. As a result, affiliate commissions on online course sales are eligible for payout immediately, without any holding period.

In rare cases of chargebacks or forced reversals initiated by the customer’s bank or payment provider, affiliate commissions for that sale may be revoked.

Currency & Fees:

All affiliate payments are made in US Dollars (USD) by default. You are responsible for any transaction fees, currency conversion costs, or taxes in your jurisdiction.

5. Promotion Guidelines

As a Hawkeye Dynamics affiliate, you’re expected to represent our brand with integrity and professionalism. The following guidelines outline what is and isn’t allowed when promoting our training programs and online courses.

Permitted Promotional Activities

Affiliates are encouraged to:

  • Promote using personal websites, email newsletters, podcasts, YouTube, blogs, and social media platforms (e.g. Facebook, Instagram, LinkedIn, X/Twitter, TikTok).
  • Share links through private groups, online communities, or professional networks where allowed.
  • Use official course descriptions, logos, banners, images, and other marketing assets provided by Hawkeye Dynamics.
  • Create educational or experience-based content (e.g. reviews, testimonials, case studies) that accurately reflects the course or training attended.

Affiliates must ensure all promotions are honest, transparent, and compliant with applicable advertising and consumer protection laws, including appropriate disclosure of affiliate relationships (e.g. “I may earn a commission if you sign up using my link”).

Prohibited Activities

Affiliates must not:

  • Use spam tactics, including unsolicited email, bulk messaging, or automated posting.
  • Make misleading claims about course results, certifications, or outcomes.
  • Use false scarcity or urgency tactics, such as fake countdown timers or claims of “limited seats” without approval.
  • Bid on paid search keywords that include “Hawkeye Dynamics,” or any variation or misspelling (e.g. brand bidding on Google Ads).
  • Impersonate Hawkeye Dynamics, its staff, instructors, or official communication channels.
  • Use offensive, discriminatory, or inappropriate content in any promotional material.
  • Host or post promotional content on websites that contain adult material, hate speech, or illegal activity.

Violation of these guidelines may result in:

  • Immediate termination from the affiliate program
  • Forfeiture of any unpaid commissions
  • Potential legal action if brand misuse or reputational damage occurs

We reserve the right to review any promotional activity at any time and request edits or removal of non-compliant content.

6. Branding & Content Usage

Affiliates are welcome to use the following official Hawkeye Dynamics materials in their promotions:

  • Logos and brand elements
  • Course summaries and descriptions
  • Approved product images and graphics
  • Social media templates and promotional banners
  • Testimonials, success stories, and media kits (where applicable)

If you would like to create your own promotional assets (e.g. video content, blog posts, graphics, email templates), these must:

  • Accurately reflect the nature and content of the training
  • Not mislead potential customers
  • Be submitted to Hawkeye Dynamics for written approval prior to publishing

All branding must follow our current style guidelines (provided upon request). Any use of the Hawkeye Dynamics name, logo, or materials outside these guidelines is not permitted.

7. Account Termination

Either the Affiliate or Hawkeye Dynamics may terminate this agreement at any time, with or without cause, by providing written notice.

Upon termination:

  • Outstanding valid commissions (for approved, non-refunded purchases) will be paid according to the usual payout schedule.
  • The Affiliate’s access to the affiliate dashboard, promotional assets, and tracking links will be revoked.
  • The Affiliate must immediately cease using Hawkeye Dynamics branding, links, and promotional materials.

Termination may occur at our sole discretion, especially in the event of:

  • Breach of these Terms & Conditions
  • Unethical or damaging promotional behaviour
  • Inactivity for a prolonged period (e.g. no activity for 6+ months)

8. Limitation of Liability

To the fullest extent permitted by applicable law, Hawkeye Dynamics Ltd., its directors, officers, employees, or agents shall not be liable to you under any legal or equitable theory, including but not limited to contract, tort (including negligence), or otherwise, for:

  • Any indirect, incidental, special, punitive, or consequential damages
  • Any loss of revenue, profits, goodwill, data, or business opportunities
  • Any errors, delays, or failures in the affiliate tracking system, including untracked or misattributed referrals

This limitation of liability applies even if we have been advised of the possibility of such damages.

By participating in the affiliate program, you agree that your sole and exclusive remedy for any dispute with us arising from or related to the program is to terminate your participation.

We do not guarantee uninterrupted access to the affiliate dashboard, website, or tracking tools, and we reserve the right to suspend or discontinue any part of the affiliate program at our sole discretion.

9. Changes to Terms

We reserve the right to update, modify, or revise these Affiliate Terms & Conditions at any time, for any reason, with or without prior notice.

  • Any material changes (such as commission rate adjustments or payout structure) will be communicated to affiliates via the email address provided during registration.
  • All changes become effective immediately upon posting or communication unless otherwise specified.
  • Your continued participation in the affiliate program after any such changes constitutes acceptance of the updated terms.

We encourage you to review these terms periodically to stay informed of any changes.

In addition to changes in terms, you will also receive email updates regarding:

  • New course launches
  • Changes to product pricing or commission rates
  • Policy updates relevant to affiliate participation
    Please ensure your affiliate account email is current and monitored.
